5. Intellectual Property Rights

The services and their original content, features, and functionality are and will remain the exclusive property of Dominate Brand AI. Our services are protected by copyright, trademark, and other laws of both the United States and foreign countries.

6. Payment Terms

Payment for services is due according to the terms specified in your service agreement. We reserve the right to refuse or cancel any order at any time for reasons including but not limited to product or service availability, errors in pricing information, or problems identified by our fraud detection systems.

7. Service Level and Availability

While we strive to provide uninterrupted service, we do not guarantee that our services will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the services, resulting in interruptions, delays, or errors.

8. Limitation of Liability

In no event shall Dominate Brand AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the services.

9. Indemnification

You agree to defend, indemnify, and hold harmless Dominate Brand AI and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses arising from your use of and access to the services.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the services will immediately cease.

11. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of North Carolina, United States, without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect.
